Terms and Conditions

§ 1 Scope and contracting parties

These terms apply to all services provided by RAB Ärztliche Bereitschaftsdienst Berlin (sole proprietorship, owner Tobias Reiche, Roscherstraße 3, 10629 Berlin — hereinafter "RAB Berlin") to patients. Conflicting or supplementary terms only become part of the contract if we expressly agree to them in writing.

§ 2 Scope of services

RAB Berlin mediates and delivers private medical house calls by specialist physicians in all 12 Berlin districts. We provide in particular:

• Acute internal-medicine and general-practice house calls
• Paediatric house calls for children and adolescents
• House calls for seniors and patients with multiple morbidities
• Hotel doctor visits for international guests
• English-speaking consultation and documentation
• Private prescriptions, sick certificates, medical reports
• Organisation of hospital admission or specialist follow-up

Service hours are daily from 6 a.m. to midnight, including weekends and public holidays. The typical arrival time in Berlin is 60 to 90 minutes and depends on traffic and current workload — it is not owed as a fixed commitment.

§ 3 Conclusion of contract

A booking enquiry by phone, WhatsApp, e-mail or the online form on akuttherapie-online.de constitutes an offer by the patient. The treatment contract under § 630a German Civil Code is concluded once RAB Berlin confirms the request by phone or message and a physician is dispatched. There is no claim to acceptance — particularly in cases of full capacity or when a house-call setting is medically unsuitable.

§ 4 Fees and billing (GOÄ)

Fees are calculated exclusively in accordance with the German Schedule of Medical Fees (GOÄ) as in force from time to time. The actual services rendered are billed, supplemented by time and travel fees and, where applicable, surcharges for night, weekend and holiday visits (Sections F, G, H GOÄ).

RAB Berlin treats privately insured patients, civil servants entitled to "Beihilfe", self-payers and international insureds. For statutorily insured patients the out-of-hours statutory service 116117 is competent; self-payer treatment is possible in individual cases, but the statutory health insurer usually does not reimburse.

You will receive the invoice on paper or electronically after completion of the treatment. Billing is handled either directly by RAB Berlin or via a private medical clearing house (PVS) acting as data processor. We are happy to provide an indicative cost estimate on request.

§ 5 Patient rights and duties

Patient rights under §§ 630a et seq. German Civil Code apply: in particular the right to information, consent, access to the medical file and complete documentation. Patients are obliged to provide complete and truthful information about pre-existing conditions, current medication, allergies and current symptoms. Incorrect or incomplete information may compromise treatment — the provider's liability remains unaffected.

§ 6 Arrival and access to the residence

Please make sure the attending physician can reach the residence without difficulty (front door, doorbell label, floor, lift code if any). For hotels please state the hotel name, room number and reception extension. Waiting time caused by missing access can be billed as time fees under GOÄ.

§ 7 Cancellation and no-show

A house call can be cancelled free of charge until the physician's arrival, provided you notify us by phone or WhatsApp in good time. If the physician arrives as agreed but treatment cannot take place due to absence or inability to reach you, we reserve the right to invoice a flat travel and time fee under GOÄ.

§ 8 Confidentiality and data protection

All attending physicians and persons working for RAB Berlin are bound by medical confidentiality under § 203 German Criminal Code and the Professional Code of the Berlin Medical Association. Information about your treatment is only shared with third parties with your express release from confidentiality. For the rest, our privacy policy applies.

§ 9 No promise of cure

Medical activity is a service obligation, not a contract for works (§ 630a German Civil Code). A particular treatment success is expressly neither owed nor promised. All content on akuttherapie-online.de is for general information only and does not replace a personal medical examination.

§ 10 Liability

RAB Berlin's liability is governed by statutory provisions. Claims for damages arising from breach of treatment-contract obligations and from tort are limited to intent and gross negligence — this limitation does not apply to damage from injury to life, body or health or to the breach of duties whose fulfilment is essential to the proper performance of the treatment contract.

§ 11 Payment terms

Private medical invoices are due for payment within 30 days of the invoice date (§ 12 GOÄ). Payment methods: bank transfer to the account stated on the invoice; direct payment by EC or credit card on house calls is also possible where technically available.

§ 12 Severability

Should any provision of these terms be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a regulation that comes closest to the economic purpose of the invalid provision.

§ 13 Applicable law and place of jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Berlin if the patient is a merchant, public-law legal entity or public-law special asset.
