Privacy Policy
This statement informs you about the nature, scope and purpose of the processing of personal data when you visit this website and use our services.
1. Controller
Controller within the meaning of the GDPR:
Tobias Reiche
Managing director, owner of the sole proprietorship „rab aerztlicher bereitschaftsdienst“
Roscherstraße 3, 10629 Berlin, Germany
Phone: +49 30 550 77 870
E-mail: reiche@rab.berlin
2. Hosting (All-Inkl / kasserver.com)
akuttherapie-online.de is hosted by All-Inkl.COM – Neue Medien Münnich, Hauptstraße 68, 02742 Friedersdorf, Germany (server infrastructure: kasserver.com). A data processing agreement under Art. 28 GDPR is in place with this provider. Legal basis: Art. 6 (1) (f) GDPR (legitimate interest in secure and efficient delivery of this website).
3. Server log files
For every page request the host collects technically required log data: hashed IP address, date and time, requested URL, referrer, user agent. Storage serves to maintain functionality and protect against abuse (Art. 6 (1) (f) GDPR). Hashed IP addresses are deleted after a maximum of 30 days.
4. Cookies
This website uses only strictly necessary cookies (e.g. session cookies of the booking form) required to operate the site. They are permitted without consent pursuant to § 25 (2) No. 2 TDDDG. No marketing or tracking cookies are set.
5. Booking form
When you book a house call we process the following data:
- Name (salutation + surname)
- Phone number (for callback, required)
- Berlin district and, where applicable, address
- Reason / symptoms (short description)
- Optional: e-mail address
Legal basis: Art. 6 (1) (b) GDPR (preparation and execution of the treatment contract) and, for the medical history, Art. 9 (2) (h) GDPR in conjunction with § 22 BDSG. Symptom details are optional but help us to dispatch the most suitable specialist.
6. WhatsApp Business API
For order intake and patient communication we use the WhatsApp Business API operated by Meta Platforms Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland. When you contact us via WhatsApp, message content, metadata and your phone number are transferred to Meta. Data transfers to the United States cannot be excluded; Meta relies on the EU Standard Contractual Clauses (Art. 46 (2) (c) GDPR). Legal basis: Art. 6 (1) (b) GDPR (pre-contractual measures) or Art. 6 (1) (a) GDPR (consent through active contact). You may alternatively use phone, e-mail or the booking form.
7. Phone calls and e-mails
If you contact us by phone or e-mail, your details are stored to process the request and for any follow-up questions (Art. 6 (1) (b) and (f) GDPR). No transfer to third parties takes place. E-mail correspondence is deleted once the matter is resolved unless commercial or tax retention obligations apply.
8. Patient data and billing
Health data processed within a medical treatment is governed by Art. 9 (2) (h) GDPR in conjunction with § 22 BDSG, § 630a German Civil Code and § 203 German Criminal Code. Medical records and invoices are retained for 10 years under § 630f BGB and § 14 GOÄ. Private billing is handled either directly by the sole proprietorship or by a private medical clearing house (PVS) acting as data processor — we will inform you of the specific entity on request.
9. Web analytics (optional Plausible)
If we use reach measurement we use Plausible Analytics exclusively in a self-hosted or EU-GDPR-compliant configuration (hosting in the EU). Plausible sets no cookies, issues no individual IDs and does not transfer personal data to third countries. Consent is not required under § 25 (2) No. 2 TDDDG. A notice will appear here should Plausible be active.
We use no Google Analytics, no Facebook Pixel, no ClickCease and no Trustindex widgets.
10. Device access (§ 25 TDDDG)
Only strictly necessary information is stored or read on your device. Consent under § 25 (1) TDDDG is not required because the exception under § 25 (2) No. 2 TDDDG applies (strictly necessary for the provision of the telemedia service).
11. Your rights as a data subject
You are entitled at any time to:
- Access to your personal data (Art. 15 GDPR)
- Rectification of inaccurate data (Art. 16 GDPR)
- Erasure ("right to be forgotten", Art. 17 GDPR)
- Restriction of processing (Art. 18 GDPR)
- Data portability (Art. 20 GDPR)
- Objection to processing (Art. 21 GDPR)
- Withdrawal of consent with effect for the future (Art. 7 (3) GDPR)
An informal e-mail to reiche@rab.berlin is sufficient to exercise your rights.
12. Right to lodge a complaint with the supervisory authority
You have the right to lodge a complaint with a data protection supervisory authority. The competent authority for us is the Berlin Commissioner for Data Protection and Freedom of Information, Friedrichstraße 219, 10969 Berlin (datenschutz-berlin.de).
13. Data security
This website is delivered exclusively over HTTPS (TLS). Patient data is transmitted in encrypted form and stored on servers located within the European Union. Access is restricted to authorised personnel of the on-call service, who are bound by medical confidentiality under § 203 German Criminal Code.
